Refusing to accept the justice handed down by a Texas jury, UT is appealing the Klebe case to the Fifth Circuit. This important tenure and retaliation case is officially one step from the Supreme Court now. It is a case that all Texas higher education faculty should be following.
CORRECTION: In fact, UT is appealing two Texas jury verdicts in favor of Dr. Klebe. After the first verdict awarding Dr. Klebe $900,000, UT claimed there wasn't sufficient evidence for that decision. Accordingly, a second, separate jury awarded Dr. Klebe $400,000. Of course, Texas law limits any award to a maximum of $300,000.
